Title 11, Section 4120 and 4121 of the Delaware Code requires the Delaware State Police to maintain a registry of sex offenders available to the public via the Internet. The State Bureau of Identification is the sub-unit of the Delaware State Police responsible to provide this service with technical assistance from the Department of Technology and Information.

Important Information

Positive identification of a person believed to be a sex offender cannot be established unless the offenders fingerprints are compared against the fingerprints taken at the time of arrest or incarceration. Title 11, Chapter 85 of the Delaware Code authorizes the State Bureau of Identification to release criminal history record information upon receipt of the subjects fingerprints and a fee established by the Superintendent of the Delaware State Police. Offenders convicted for sex offenses specified under Delaware Law are required to register. Persons who have been arrested but not convicted are not required to register.

This website includes only those registered sex offenders who have been classified by the courts as moderate-risk or high-risk. Those offenders classified as low-risk are not displayed on the public website.

Who is required to register as a sex offender in Delaware?

Under Delaware law, a "Sex Offender" means any person who has been convicted of any of the following offenses, or of any attempt to commit any of the following offenses:

  • Indecent exposure 1st degree.
  • Incest.
  • Unlawful sexual contact 3rd degree.
  • Unlawful sexual contact 2nd degree.
  • Unlawful sexual contact 1st degree.
  • Rape 4th degree.
  • Rape 3rd degree.
  • Rape 2nd degree.
  • Rape 1st degree.
  • Sexual extortion.
  • Bestiality.
  • Continuous sex abuse of a child.
  • Dangerous crime against a child.
  • Female genital mutilation.
  • Dealing in children.
  • Sexual exploitation of a child.
  • Unlawfully dealing in child pornography.
  • Possession of child pornography.
  • Sexual solicitation of a child.
  • Violation of privacy, when it includes tape recordings, photographs, films, videotapes or other reproductions of the image of another person who is getting dressed or undressed or has his/her genitals, buttocks or her breasts exposed, without consent, in any place where persons normally disrobe, including but not limited to a fitting room, dressing room, locker room or bathroom, where there is a reasonable expectation of privacy; or when it includes secretly using tape recordings, photographs, films, videotapes, or otherwise recording another person through his or her clothing for the purpose of viewing the body of or the undergarments worn by that other person.
  • Promoting prostitution 2nd degree, when the person advances or profits from prostitution of a person less than 18 years old.
  • Promoting prostitution 1st degree, when the person advances or profits from prostitution of a person less than 16 years old.
  • Obscenity, if the person sells, delivers, or provides any obscene picture, videotape, video game, writing, record, audio cassette tape, compact disc or other representation or embodiment of the obscene to a person under the age of 18.
  • Kidnapping 2nd degree, in the event the crime is committed with the purpose of inflicting physical injury upon the victim, or to violate or abuse the victim sexually.
  • Kidnapping 1st degree, in the event the crime is committed with the purpose of inflicting physical injury upon the victim, or to violate or abuse the victim sexually.
  • Trafficking of persons 787(b)(2).

What does "convicted" mean?

"Convicted" shall include, in addition to its ordinary meaning, adjudications of delinquency and persons who enter a plea of guilty, or are found guilty but mentally ill or not guilty by reason of insanity.


If someone is convicted of an offense requiring registration, in another state, and then moves to Delaware, is that person required to register in Delaware?

Yes. Registration is required for anyone who has been convicted of any offense specified in the laws of another state, the United States or any territory of the United States, or any foreign government, which is the same as, or equivalent to, any offense which is considered registerable in Delaware.


What information is a registered sex offender required to provide?

Sex offenders must complete a registration form and submit it to the Sex Offender Registry at the State Bureau of Identification. Registrants are required to provide:

  • All names and aliases ever used.
  • Date of birth.
  • Driver's license or state issued identification card.
  • Telephone numbers, including home and cellular phone numbers.
  • Social Security number.
  • Residential address or addresses.
  • Employer name, address and telephone number.
  • School name, address and telephone number.
  • Vehicle information for all vehicles owned or operated, including the year, make, model, color, and license plate number.
  • All email addresses and Internet identifiers.
  • Copy of passport.
  • Immigration status.
  • Copies of any professional licenses.

What are "Tier Levels"?

All out of state offenders will be assigned a tier by the superior court after a motion is made by the AG's office requesting a tier. All instate offenders who do not already have a tier (primarily crimes occurring before 1997) will be sent a letter with a presumptive tier assigned. The offender may then seek a BOP review or leave the tier in place without review. Tier 1 offenders are classified as low-risk, tier 2 offenders are classified as moderate-risk, and tier 3 offenders are classified as high-risk.


How long do offenders remain on the sex offender registry?

Tier 1 offenders must register for 15 years. Tier 2 offenders must register for 25 years.


Is it possible to get a lower tier level, or be removed from the registry?

  • Tier 1 offenders may petition Superior Court for relief from designation as a sex offender after 10 years, if the offender has successfully completed a state-approved sex offender treatment program and has not been convicted of any crime, other than a motor vehicle offense, during such time.
  • Tier 2 offenders may petition the Superior Court for designation as tier 1 after 10 years, if the victim was not a child under 18 years of age, and the offender has successfully completed a state-approved sex offender treatment program, and has not been convicted of any crime, other than a motor vehicle offense, during such time.
  • Tier 3 offenders may petition the Superior Court for designation as tier 2 after 25 years, if the offender has successfully completed a state-approved sex offender treatment program and has not been convicted of any crime, other than a motor vehicle offense, during such time.

When do registered sex offenders have to update their registry information?

Registered sex offenders must report any change in their registry information within three (3) days. The change must be reported in-person at the State Bureau of Identification (SBI) in Dover, or at SBI-North at State Police Troop 2 in Glasgow. Offenders who are on probation may request that their probation officer update their registry information.


Are registered sex offenders required to regularly verify that their registry information is accurate?

Yes. All registered sex offenders must report to SBI in-person on a regular basis, even if none of their registry information has changed. Tier 1 offenders must verify their information once a year, tier 2 offenders must verify their information twice a year, and tier 3 offenders must verify their information four times a year. All registrants must submit to having their mugshot and fingerprints taken each time they verify their information. This must be done in-person at SBI.


What about registered sex offenders who are registered as being "homeless"?

Homeless registrants must verify their registry information on a more frequent basis. Tier 1 homeless registrants are required to appear at SBI in-person every 90 days, tier 2 homeless registrants must appear in-person at SBI every 30 days, and tier 3 homeless registrants must appear in-person at SBI every seven (7) days.


What is the penalty if an offender fails to comply with the registration requirements?

Offenders who fail to update their registry information within three (3) days, or who fail to verify their information as required, will be charged with Failure to Re-register as a Sex Offender, which is a class "G" felony.


When is the public notified?

Information regarding tier 1 sex offenders is limited to law enforcement agencies. For tier 2 and tier 3 offenders, schools and daycare centers are notified when an offender registers as residing, being employed, or studying in the area. Additionally, for tier 3 offenders, immediate neighbors are notified.


Who is responsible for notifying the public?

Community notification is made by the police agency having jurisdiction over the offender's place of residency, employment, or study.


Are registered sex offenders posted on the Internet?

Yes, with the exception of tier 1 offenders. Under state law, tier 1 offenders are not posted on the Internet. Tier 2 and tier 3 offenders are posted on the state's public sex offender website, http://desexoffender.dsp.delaware.gov.


How often are the registry and the public website updated?

Delaware's sex offender registry and the state's public website are updated daily.


Can I receive email notification when an offender moves into my neighborhood?

Yes. Delaware's public sex offender website offers a free email notification system, which will alert you when an offender lives, works, or goes to school in your area.


Is there a national sex offender website?

Yes. The National Sex Offender Public Website is online, at www.nsopw.gov.


If an offender moves to another state, does the offender have to comply with Delaware's requirements, and the requirements of the state they move to?

Yes. The offender must advise the Delaware registry within three (3) days of moving. Delaware will then notify the new state that the sex offender is relocating to that state. The offender must then contact the new state to properly register. Once a registrant no longer lives, works, or studies in Delaware, the offender is no longer required to update their Delaware registry, unless he/she returns to the state.


Do out-of-state registrants have to register in Delaware, even if they only have a job or go to school in Delaware?

Yes. Federal and state law requires offenders to register in all jurisdictions in which they live, work, or go to school.


If I find out my neighbor is a registered sex offender, am I allowed to tell my other neighbors?

Yes. All information posted on the public sex offender website is considered public knowledge. However, this information can not be used to harass any individual. Those who wrongfully use such information to harass an individual will be subject to prosecution.


What if I have information that a registered sex offender is not living at his/her registered address?

Anonymous tips can be submitted to the Delaware State Police Sex Offender Apprehension and Registration (S.O.A.R.) unit via the public sex offender website, http://desexoffender.dsp.delaware.gov or by phone, at (302) 739-5882.
