Canadian Background Checks Vary from USA Checks Federal Solicitor General Lawrence MacAulay today introduced reforms to the Criminal Records Act (CRA) that will make criminal records of pardoned sex offenders available for background checks.
As the CRA stands now, an agency serving children and other vulnerable groups can request applicants for volunteer or paid positions to provide proof of a background check of criminal records through the RCMP’s Canadian Police Information Centre – CPIC. But pardoned records will not show up during a routine search of CPIC records by local police.
One of today’s proposed amendments will ensure that the criminal records of pardoned sex offenders seeking positions of trust are available for screening purposes. By placing a ‘flag’ on the records of sex offenders, police can be alerted that a sealed, pardoned record exists so they can then request the Solicitor General’s authorization to unseal it.
